The only ones whining & making news about hospital bed shortages are the ones who are causing the shortage by closing icu units in hospitals and now firing doctors, nurses, technicians, and hospital staff for not getting the vaccine! It’s the never ending vicious cycle of leftist’s who can really no longer be called liberals because they have morphed into full fledged marxists!

“A federal judge in New York granted a preliminary injunction Tuesday in favor of 17 health care workers applying for religious exemptions to the state’s COVID-19 mandate.”

In the MEMORANDUM-DECISION and ORDER we find:

“Finally, plaintiffs have established at this early stage of the litigation that § 2.61 is likely to fail strict scrutiny. To satisfy strict scrutiny, defendants must show that the challenged law advances “interests of the highest order” and is “narrowly tailored” to achieve those interests. Fulton v. City of Phila., Pa., 141 S. Ct. 1868, 1881 (2021) (quoting City of Hialeah, 508 U.S. at 546). “Put another way, so long as the government can achieve its interests in a manner that does not burden religion, it must do so.” Id.”.

Now, all we have to do is get the Union lawyers representing NYC teachers, to get strict scrutiny protection for NYC teachers, who are having their liberty, medical privacy and autonomy infringed upon by the COVID vaccine mandate.

See: Rivers v. Katz (67 N.Y.2d 485) 1986, a New York State Court of Appeals decision, to establish a fundamental right is being infringed upon by the NYC vaccine mandate. In the case the Court stated:

” In Storar, we recognized that a patient’s right to determine the course of his medical treatment was paramount to what might otherwise be the doctor’s obligation to provide medical care, and that the right of a competent adult to refuse medical treatment must be honored, even though the recommended treatment may be beneficial or even necessary to preserve the patient’s life. This fundamental common-law right is coextensive with the patient’s liberty interest protected by the due process clause of our State Constitution.

In our system of a free government, where notions of individual autonomy and free choice are cherished, it is the individual who must have the final say in respect to decisions regarding his medical treatment in order to insure that the greatest possible protection is accorded his autonomy and freedom from unwanted interference with the furtherance of his own… ”.

The insurance company is not requiring the vax in this situation. The hospital is requiring the vax to do the surgery.

If the hospital/surgeon did not follow published guidelines/recommendations from the professional society overseeing transplants and a bad outcome occurred, what do you think the insurance company would do?

Precisely, and if it is CMS looking at it, look out. You could face losing the entire index procedure payment. Huge loss for the hospital there.

So link to the published guidelines from the professional society stating surgeries recipients need covid shots. I quarentee you that is not true in a lot of states. I think you guys are making up scenarios to try and defend your bias.

Bad outcomes happen everyday, there is a reason you have to sign waivers.

It was already linked to in this thread. This is a national organization. Individual states don’t matter.

Waivers are meaningless when guidelines and standards of care aren’t met. You can’t sign a waiver to allow negligent care.

Sure it does. I quarentee you they don’t require covid shots where I live.

As for the link, please link the part that says no covid shot no surgery in United States. I don’t believe you when say it is there. Also it wasn’t a required vaccine in Aug when they went for their consult.

Getting a covid shot is not a standard of care of the hospital it is of the individual. Now you are just making stuff up.

Transplant surgery.

That’s what the American Society of Transplantation guidelines state. If you are being considered for a solid organ transplant, you need to be vaccinated. There are other vaccination requirements beyond COVID for transplants. Those guidelines were also posted.

It becomes standard of care once it is a national guideline.

I didn’t see anything in there on covid. Yes it did talk about others but we are not talking about those. What studies have been done on the positive or negative affects on transplant recipients.

This is pointless. AST guidelines state vaccination against COVID is needed for solid organ transplant. If you don’t like it or agree with their reasoning, write them a letter. Hospitals and surgeons follow their guidelines. Full stop

Not only does the recipient need to be fully vaccinated, so does the donor if they are directly donating to that individual specifically. And even the dogs and cats in the house have to be vaccinated! This is how it is done, we aren’t making crap up we deal with renal transplants often. My hospital has a wonderful program and during my internship 28 years ago I spent a month under the director of the program. He was an amazing Physician.
