How do you have an impeachment trial without a judge?

The Chief Justice states he is not constitutionally obligated to preside over this impeachment as he is no longer president.

He seems to have a better handle on the constitution than you do.

When the President of the United States is tried, the Chief Justice shall preside:

If they are holding an impeachment trial on the president then the chief justice is there. I don’t see anything about former, out of office, or anything. He was indicted as the president, he is being tried as the president.
Either that or the impeachment indictument is no longer valid.

They can hold a trial (word from the constituion) but the Cheif Justice SHALL (word for the constition) preside.

They didn’t say anything about a “fair” trial. Roberts is only required if a President is put on trial. In this case, a civilian non-office holder is being put on trial.

The impeachment article passed by the house was for a person holding the office of PRESIDENT.
The senate trial is for a person that was impeached in the office of PRESIDENT.

They aren’t trying an ordinary citizen. President Donald J. Trump** was the sitting President at the time he was impeached and was not, and is not, an “ordinary citizen”.

Whether Senate, after having a trial, will convict (conviction vote with 2/3’s confirming), acquit (conviction vote with less than the 2/3’s threshold), or dismiss (vote after arguments by a simple majority) is up to the Senate.

Seems to me, Donald John Trump is not the “President of the United States”, so how do you impeach a president, when he is not the president?

Additionally, our Constitution states: “The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside:”

So, according to the Articles of Impeachment against the “President of the United States”, Chief Justice Roberts is to preside. But, I hear tell that Senator Patrick Leahy will preside over “Impeaching Donald John Trump, President of the United States”, who is not really President of the United States as falsely declared on the face of the Democrat nitwits Articles of Impeachment, but if true, requires Chief Justice Roberts to preside.

Snow, please don’t put words in my mouth even phrasing it as a question.

I’m fine with the Chief Justice presiding because President Trump** was President at the time of impeachment. Also fine with the Senate and the Chief Justice determining that ex-President impeachment don’t require the Chief Justice to preside as the Constitution is not clear on that point.

Saying that someone impeached as President whose trial doesn’t happen until the individual leaves office is not an “ordinary citizen” has nothing to do with who presides.
