Why not call it the “private sale loophole” then?

The answer is because that would tell the uninformed what they are actually going after.

Because the loophole is, a consumer can go to a gun show and browse table after table of guns - much like going to a store and seeing hundreds of weapons to choose from. But despite the gun show as a whole acting like a huge gun shop, it is really inndividual gun sellers at each table, so BGC aren’t required.

But honestly who cares what it is called?

Let me guess. This is what you’ve heard about gun shows from someone who’s never been to one.

Because it’s obvious to anyone in the know that wherever this idea of tables and tables of unlicensed individuals selling guns came from has never actually been to a gun show.

The last show I went to had nothing but FFL dealers. If there was any private sales going on I didn’t see it.

Yup. That’s pretty much how they all are.

Only one time have a seen a private seller with a large table/booth at a gun show.

An old gun collector had passed away and the family was selling his collection.

Somehow people have this idea of guys driving around in cargo vans selling guns at gun shows without a license. I think it was from a movie, and now the anti gun crowd thinks that’s reality.

People know when these proposals are put on the ballot it’s about private sales.

Sure, but that doesn’t help your case. ATF is concerned with intent. If you get busted by ATF with intent to sell for profit, or as a business, you’ll be charged. Even if it’s just one gun.

There are any number of reasons why a private seller might be at a gun show. However, if they are at a gun show, selling in volume, they better be selling off an inherited collection or their personal collection for solid reasons. Otherwise, they’ll be paying a hefty fine and occupying a cell. Simply stated, they aren’t “effectively” dealers because they can’t move material in the volume that a dealer can, nor make money off of the enterprise to any significant degree. At least, not if they want to keep their money and their freedom.

I think we can all agree that we all abide the law and can supply indentifcation and non felonious background let alone one exhibiting mental health issues. It’s certainly time for extensive background checks for those Americans with nothing to hide. If you should have to present identification to vote or aplly for a Drivers Liscense thrn certainly you should be required to do no less when buying firearms.

Interesting correspondence. In my state you have to show ID to register to vote, but when I vote all I am asked to do is sign the register to guarantee it is me.

If we think of the analogy to guns. Showing your ID to vote is equivalent to having to show your ID every time you fire the gun. Showing ID to acquire the gun is equivalent to registering to vote.
