Hopefully Trump keeps promise to end birthright citizenship for children born to illegal entrant foreign nationals

In 1868, virtually all babies born to immigrants were essentially anchor babies, Citizenship for immigrants was predicated by residing here for several years (among other requirements.) Yet their children born here were automatically Citizens.

This particular confusion has been around for some time. I believe the SCOUS will want to get it settled once and for all.

maybe Thomas/Alito. I don’t get that any other justice is interested in a 2+ hours of audio questioning both sides over this. Could see Roberts and one other joining and leaving lower court rulings stand. Wonder what the hit rate on Certs to the SC where the lower courts are unanimous/near unanimous on their rulings. Some SCOTUS geek has probably already tabulated such stats.

The SCOTUS should refuse to hear it, which would have the effect of quashing it.

Actually I hope SCOTUS does…this way it will squash what we already know.

Not taking it would settle the issue for now. The lower court ruling(s) on the matter would stand.

I think there is more to the “Subject to the jurisdiction thereof” argument than meets the eye. The court is mostly textualist now and what did that phrase mean at the time of its writing. Then I saw a video where the first draft of the 14th called for all people born in the US were citizens of the US. That draft was shot down to add the phrase “Subject to the jurisdiction of”

Not really. There seems to be a handful of gifted individuals who believe they can simply read our constitution and know exactly what the authors intended. No need for constitutional scholars. No need for supreme court justices.

No need for this thread. The 14th amendment is cut and dried. If I’m not mistaken, you believe yourself to be one of those gifted individuals.
