Here They Come...Again

It doesn’t matter. They know it’s unConstitutional. They swore an oath.

That’s we said in 1994.

Background checks are unconstitutional? There are already Background check laws, right?

What does the Constitution say?

It is prior restraint.

Yes, there are. And they are unConstitutional as well. And an abomination.

I don’t know what it is, but it is most certainly not prior restraint

Question: has the SC never ruled on background checks?

It most certainly is.

Yes. The Supreme Court is not a good source for upholding the 2nd Amendment.

So, the SC has not ruled against background checks?

There is no delegation of power to Congress to enact these statutes in the first place and apply them to the jurisdictions of the States.

Long running lawlessness is still lawlessness.

No. Ibid.

See, you guys make these grave pronouncements about constitutionality. But it seems that almost every time, they are little better than an opinion based on what is actually going on in the real world.

For example, my conversation with Sneaky: he tells me that they are unconstitutional, yet they somehow continue to survive constitutional review.

Okay then. They are by definition constitutional.

Also prior restraint IS incorrect, that is a very specific concept around the First Ammendment, not the second

The SCOTUS, with a couple of exceptions, has made the 2nd Amendment a diminished right for years. Decades.

They don’t like the 2nd anymore than Shannon Watts does.

No, they are not. They have been ruled as such by omission.

No, it is not. Prior restraint is a concept that is applicable to any situation where it applies. And now you are trying to diminish a right.

For what it’s worth, the line has been drawn at Barrett. Personally, I think things are frozen in amber for a generation.

I expect I will be dead before another real challenge to gun rights goes on the books

Again, not the point.

Wait, maybe I misunderstood. I had asked if background checks had come under constitutional review, and you seemed to say that they had?

And that is just incorrect: prior restraint is a first amendment concept

Yes, they have.

No, it is not.

Oh, I know. But you should still take solace

And now Merrick Garland’s gun-grabbing ass is the AG. Watch him go.

Oh. Well then, background checks are constitutional.

You don’t get to just redefine terms, Prior restraint is a 1A concept

You don’t know what you’re talking about. Have a nice day.
