H.R. 642 - A bill to reform the Supreme Court and for other purposes

Seriously elected officials who don’t know our government system consists of three equal branches don’t belong in Congress and these two Dem dingbats should resign because this bill they introduced goes against the Constitution they swore to uphold.

It could be very interesting if a bill like this passed and the Supreme Court ruled that it was de facto doing away with the constitutional authority of the SC to be the highest court, and then the President and Congress declared the SC had no authority to make that ruling. Of course, the bill will not pass.

I have thought about that too. What happens if the SC strikes a law meant to change or reform them?

Right, but of course the difference is that only in TX (other than in the rest of single Judge districts) can one assure exactly what judge one will get, and that it will be - Matthew Kasmaryk or Reed O’Connor.

The Democratic bill is unwise and should not pass.

But it is perfectly Constitutional.

No less than Justice Felix Frankfurter, one of the most astute men ever to occupy the bench of the Supreme Court conceded, in National Mutual Insurance Company v Tidewater Transfer Company, that Congress could fully eliminate the appellate jurisdiction of the Supreme Court and numerous other Justices have concurred in this view. Only the original jurisdiction of the Supreme Court is sacrosanct, as stated in Marbury v Madison. Congress may do with the Supreme Court’s appellate jurisdiction as they wish to do.

I believe the Democratic bill to be unwise. But it is Constitutional.
