Ok so if a Bar owner sees a person wearing a Black Power or Black Lives Matter T-shirt can the Bar owner refuse to give service to the person because of the shirt?
How much you bet it would turn into Race issue over the T-shirt in that situation.

I agree with the Ruling but i don’t think it would be held equally to all.

It is the same, because the Bar Owner is not removing them from the bar because they are Black but because of the shirt they are wearing. Which is basically the same as the MAGA hat they asked them to leave because of the article of clothing.

But as i said people would view the situation as i pointed out as racists. Like you did and not the same.

“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof;”

Thus Congress cannot deny funds to, nor grant special tax status or other privileges to religions.

Slap together a set of beliefs and call it a religion, and Congress cannot recognize the fact that you call it a religion.

The 14th Amendment
“No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States…”

Extends that to states as well as the municipalities and school districts they create.

Sadly,
many have decided to mentally rewrite the first amendment a “Congress shall not create an official national religion.”

It does not read that. It does not imply that. Of course to establish a state religion Congress would first need to recognize nice that a collection of beliefs has been established as a religion so “cannot establish an official state religion” is part of what it means, but that is a small part. It goes much further.
