Federal Judge Ousts Trump's Top Public Lands Chief

Much to the relief of both Senate Democrats and Senate Republicans, another usurper has been given the iron boot from an illegally occupied office. In this case, William Perry Pendley has been removed as Acting Director of the Bureau of Land Management, with the Judge characterizing his entire service as illegal.

Because of his long record as an opponent of Federal ownership of land, he was opposed by numerous mainstream Republicans and Democrats and the Senate had previously pressured Trump into withdrawing his nomination.

As part of the judgement, the Secretary of the Interior is forbidden from appointing another Acting Director, meaning the Bureau of Land Management will be run a career member of the Civil Service unless and until Trump (or Biden) manages to get Senate confirmation of a permanent director.

As with the other similar cases, I support this decision wholeheartedly.

Trump has had a Republican Senate for his entire Presidency. It is his own â– â– â– â– â– â– â–  fault that he has not gotten Senate confirmation for some of his nominees.

Nominate somebody that the Senate will confirm.

Unfortunately, I don’t have a link to the actual Opinion of the Court at this time.

Too bad he didn’t shut down the agency.

This is a losing issue for Republicans and Trump should never have picked this clown.

Yes, I know you and others have strong feelings regarding the Bureau of Land Management.

But opposition to the BLM is a minority viewpoint in the western States. Multiple polls have been done in the past several years and overwhelming support exists for maintaining all the land under Federal control. Around 60% favor Federal control, to 35% who favor State or private control.

Ironically, the Plaintiff in this case is Montana Governor Steve Bullock, who is using the lands issue against Republican incumbent Steve Daines in their Senate race. This win is expected to benefit his campaign.

To be fair the democrats have been quite the distraction these last 3.5 years, what with all the investigations, hearings and impeachment proceedings. Not to mention the “pandemic”, brokering peace deals in the Mideast, seating 218 Federal judges (2 of them Supreme court justices), rewriting NAFTA, and a couple of other odds & ends.

Which is zero excuse for not getting a Senate confirmed director in place. It is NOT that difficult.

Funny, I live in the west, and most of the people I know don’t much care for the BLM, of course most of them don’t much care for the Federal Government either. Something about people 2500 miles away making rules and regulations about things they don’t really understand.

sure it is, when the democrats have been throwing a temper tantrum for 3.5 years straight. Hell, Pelosi won’t even try to negotiate a second stimulus, and that is a bit more important than the BLM director. Give a little more time, After Trump is re-elected He’ll have time to address the issue, unless of course the Democrats continue with the nonstop temper tantrums.

No it is not.

Trump should have nominated an acceptable individual a LONG time ago and he would have been confirmed and this issue would not exist.

Any reference to so called temper tantrums or anything else is irrelevant and pure deflection.

Trump is 100% at fault for this situation. Nominate and individual and get him confirmed. If the Senate doesn’t like him, nominate somebody the Senate does like.

Trump is only screwing himself and reducing his own effectiveness by failing to get Senate confirmed nominees.

If you say so.

He had no problem nominating judges and getting them through. So why not go through same steps to get this Director confirmed? Perhaps becsuse he knew this guy couldn’t/ wouldn’t get confirmed.

That is really the ridiculous thing.

If Trump had nominated an acceptable individual, he would have been confirmed long ago and this problem would not exist.

The above link has the actual Opinion of the Court embedded in it.
