Federal Circuit Grants Apple Petition for Writ of Mandamus to Transfer Uniloc Suit

Glad to see Apple rescued from Judge Alan D. Albright’s personal judicial hellhole in the Western District of Texas. The United States Court of Appeals for the Federal Circuit granted a Petition for a Writ of Mandamus by Apple that transferred the case from the Western District of Texas to the Northern District of California.

Not mentioned in the article is the fact that Plaintiff Uniloc is a patent troll. This is basically a shakedown of Apple. At least Apple will have a less plaintiff friendly venue to fight this case now.

Again, Congress needs to seriously tighten up venue rules for intellectual property cases. Frankly, I would allow Intellectual Property defendants the right to change venue to the district in which their company is headquartered, denying IP Plaintiffs (particularly patent trolls) the ability to choose venue.
