The only legal issue was whether two people lied. That isn’t really the big issue. The bigger issues were that one of the political parties created a fake dossier and used that to undermine an elected administration. Further, a national police force used its power to destroy an administration even though it new the basis for its allegations were a partisan fake dossier.
Both the party and th political party kept truths that would have shown it’s allegations were hoaxes hidden.
I think your scenario is more fitting to the Mueller report, where the chief investigator refused to answer questions about his investigation.

Do I have proof that the Democrats paid for the dossier for partisan political purposes? No, I was not there when the payments were made. Others have documented this. The founders of a company named Fushion GPS testified to it before congress, as lying about it could be illegal.
Was I in congress when they testified? No. I am basically relying on every newspaper and news article in the country reporting that they did admit the payments before congress.
If you have a separate reality, can you prove it?

It actually is an issue for him because of the two criminal cases that his investigation developed, both of them failed.
That says very bad things about the quality of his work.
