They would have had to pass it by themselves, since every single GOP member would vote against codifying Roe. There were enough Dem Senators who hailed from Red or Purple states that getting 60 votes in the Senate was never going to be easy. They should have put them on the record as opposing it, but it would have also put their own vulnerable Senators on the record, which they didn’t want.

So nothing got done, despite it being the right thing to do.

Abortion isn’t a right and never has been. It is not outlined in the Constitution, except:

  • Life, liberty, and pursuit of happiness will not be undermined except with due process of law. Meaning by trial. And murder is illegal.

  • Every person is granted their rights by their creator. That would also include infants inside the womb.

You also argued a while back about women not getting treatment for miscarriages. Miscarriages are different, and treatment is not outlawed- many states allow for exception for the mother’s life, which this situation is. Texas and Oklahoma, with the most stringent bans on abortion, allow for the exception of the mother’s life.

If hospitals do not treat a woman suffering from a miscarriage, it is probably for a different reason, like wait times and understaffing. There has been a nurse shortage for a while and many health care workers are burnt out. So we see apathetic carers and longer wait times. It’s also evidenced by the fact it’s not just miscarriages. It’s seizures and other issues. In a review, there was one person in the waiting room at St. Francis hospital in my hometown of Tulsa, OK who was having seizures in the waiting room, who was ignored. I believe another person in another review saw that his father died in the waiting room due to either an MI or a pulmonary embolism. There were also people with enteroviruses and pneumonia who were waiting several hours and they had not talked to one staffer that even asked how they were doing. A woman who was life-flighted to St. Francis’ ER with her trach swollen shut and a mystery cist waited 13 hours (in a gurney in the hallway) and then in triage before her doctor showed up.

XX people for the most part, there are variants which still express female genital anatomy though, including some XY females (Swyer syndrome) and XXX females who are usually silent clinically. Oh, and X which is Turner’s syndrome. Missing a whole chromosome there. All born with female genitalia.

There is such a thing as a therapeutic abortion. It’s a D&C. Same process to clean out a miscarriage as to having an abortion. When a woman miscarries, she literally needs an abortion to clean out the products of the pregnancy that still lie within her. They are highly prone to infection and hemorrhage.

But some women can expel the contents naturally and completely. So, how do you know if you are safe? For the most part, you don’t. But if the miscarriage falls outside an imposed window, the MDs are forced to wait until the patient is clinically ill enough to merit the D&C. Which is why women are often forced to wait until they are either septic or have lost enough blood to merit the late term “abortion”.

This can destroy a woman’s future chances at fertility, by the way. Or even her life if she dies from sepsis. It doesn’t need to be this way, but the laws are intentionally vague enough that physicians are hesitant to give D&Cs when they are needed for fear of prosecution and loss of license.

Tenichally abortion is assault with a deadly weapon and child abuse. I think all abortionists should at least be charged with these if they fail and with murder if they succeed.

Why just the abortionist?

If it’s murder, assault with a deadly weapon and child abuse - why will no one charge the woman with murder, assault with a deadly weapon and child abuse.

If a woman hires a contract killer to kill her husband, she’s still charged with the murder, so why not charge the woman who hired a contract killer to kill the unborn baby?
