The article indicates the purpose is to acquire data from drug companies to determine the efficacy and risks of the vaccine. Is that a problem?

Investigating potential fraud is not a regulation of commerce. States bring actions against companies all the time for commercial fraud.

However, in this particular instance, States cannot regulate the approval of medication or medical devices in a manner inconsistent with the decision of the FDA. Buckman Co. v. Plaintiffs’ Legal Comm., 531 U.S. 341, 348 (2001), so any investigation by Florida could not compel compliance by the drug makers.

Yes, leave science to the best scientists money can buy.

Yes, the FDA regulates drugs and vaccines. On the other hand, criminal fraud is still a state crime and worthy of investigation.

If fraud is proved, then vaccine makers can lose their protection against civil lawsuits.

Fraudulent public claims and liability aren’t in the realm of approval. They are in the realm of fraud.

At first Pfizer said their vaccine had a 91% efficacy but when Moderna introduced their’s and claimed a 94% efficacy, Pfizer mircaculously jumped to 95% within a week. Now…is the claim of a 95% efficacy that was stated by Pfizer and used by patients to make their decision…the truth, the whole truth and nothing but the truth…yes…or no?

It’s good that someone within our government, that has the power to investigate this, is doing so. It’s all the rest of our government turds that would NEVER investigate this, is in part why I despise politicians.

OK, but fraud on whom? If it’s on the public, the. The FDA approval is going to trump any theory of misrepresentation, and if it’s fraud on the FDA, it will be preempted because the FDA has maintained its approval. Either way, it gets removed (if civil) to Federal Court, and the 11th Cir., has not been friendly to cases that seek to thwart an FDA approval. If it’s criminal, there is still a preemption problem, and a parallel action in Federal Court will likely result in an injunction against the prosecution. The Supremecy Clause and the terms of the Food, Drug and Cosmetica act pretty much dictate this outcome.

What needs to be investigated that isn’t already being looked into or thoroughly documented in studies/trials?

Possibly…lies? Does the Pfizer vaccine actually have a 95% efficacy? Did the POTUS lie?

Misleading and misrepresenting the efficacy. Side effects and if there was any suppression of that information, etc.

I recall when the vaccine came out people were clamoring to get it. The belief was they would have immunity from Covid. Then, the 5% was to blame if you got Covid. We know you still get Covid even if you have the vaccine. So, it is misrepresentation to begin with to call it a vaccine, is it not?

What about pushing it for children? We were told safe and effective. We know that young adults are suffering from myocarditis after being vaccinated.
