SEE: Bill Cosby freed after US court quashes sex crimes conviction
“US comedian Bill Cosby was freed from prison Wednesday, in a blow to the #MeToo movement, after a US court overturned his conviction for drugging and sexually assaulting a woman 15 years ago.”
It’s saddening how those entrusted to uphold the “rule of law”, have not only used their positions of power to “legislate from the bench” and make our laws mean what they want them to mean as happened in Bostock v. Clayton County, 590 U.S., where the majority on the court used the Humpty Dumpty theory of language to make the word “sex”, as found in the 1964 Civil Rights Act, mean what they wanted it to mean, but now these scoundrels are shown to use their position of public trust to overturn a conviction of a sexual predator who took liberty of sixty women.
Let us remember the definition of tyranny, as defined by one of our founding fathers.
”The accumulation of all powers, legislative, executive, and judiciary, in the same hands [e.g.,our judicial system] . . . may justly be pronounced the very definition of tyranny.” ___ Madison, Federalist Paper No. 47

Wait a minute: isn’t the basis of our criminal justice system fairness?
As I understand it, Cosby agreed to testify in a civil suit, with the understanding that the testimony wouldn’t be used against him in the criminal case. And then, the prosecution went back on it’s word.
Is that okay to you?
As you understand it?
Tell me, did you read the DISSENTING OPINIONS?

The Equality Act attempts to exercise legislative power proposed under the “Equal Rights Amendment” which was wisely rejected by the American people, and thus, to this degree, the Act is an attempted usurpation of legislative power not granted.
You should probably read the dissents.
One says that he doesn’t believe it could not have been reduced to writing.
The other one argues that a government employee whose actions affects a persons rights can’t bind the government to affect a persons rights. That’s some scary stuff.
The crime that was committed should not over ride due process. For a constitutionalist to argue that this is all unfair is astonishing to say the least
I think it sucks that Cosby has escaped justice, but what: if the crime is bad enough, we should just ignore the constitution?

Hey the last guy acting as an agent of the Federal Government has no say in what the Federal Government does when the last guy is no longer acting as an agent of the Federal Government. What could possibly go wrong with that?
What is a good argument against “He was given immunity ?”

The right to not incriminate oneself is a bedrock principle of the Founders.
You simply cannot coerce or trick someone into incriminating themselves and then expect you can lock them up once it’s been done.
That’s what Bruce Castor (who is no liberal, BTW) did.
It’s tragic that Cosby is out (although his sentence was 3-10 years and he served 2 of them, so there was some justice meted), but it was no “liberal twisting of justice” that got him out.

They disagreed with the remedy.
They would have awarded him a new trial with the questionably obtained evidence suppressed.
The result IMO would have been the same…that evidence was critical to Cosby’s conviction.
They agreed broadly with the thinking…they didn’t agree that Castor had what amounted to “pardon power”.
Either way…Castor ■■■■■■ up. The prosecution ■■■■■■ up.

Not the first time, or the last, that overzealous prosecutors botched a case. Better a hundred guilty men go free than one innocent be jailed. Though I have a different view of consciousness and so a different sense of justice.
Humans don’t have free will, they have a limited, very limited, free will of won’t.

If you pay attention to human cognition, humans aren’t very sentient. We basically train unconscious subroutines and then observe narrate the results. We delegate to the undernind
When I do basic math in my head I don’t do all the operations I delegate most of it to my brain which is not accessible to my prefrontal cortex. That’s just a fact

Exactly! But more than just that!
When I was studying law, I was taught to always read dissenting opinions, which, on many occasions, shed light on important subject matter. In this case, JUSTICE DOUGHERT eloquently confirms the majority’s opinion to bar further prosecution is wrong!

“. . . we can return him [Cosby] to the position he enjoyed prior to being forced to surrender his Fifth Amendment right against self-incrimination by simply suppressing the evidence derived from the civil depositions at which he testified. We should not use Castor’s “blunder” to place Cosby in a better position than he otherwise would have been in by forever barring his prosecution. “So drastic a step” merely “increase[s] to an intolerable degree interference with the public interest in having the guilty brought to book.” Blue, 384 U.S. at 255.6”

The Equality Act , if imposed upon the people as a federal “rule of law”, and without their consent, it would not only subvert the human right of American citizens to be free to mutually agree in their social and commercial activities ___ it would allow federal bureaucrats to dictate almost every aspect of the American peoples’ social and commercial activities.
His biggest mistake was telling young black men to pull up their pants. After that he was on the “get him” list…
It looks like Bill Cosby just created another batch of powerful people ready to go after him.
