That is true too but since we’re talking about an incident taking place in the dark that’s what I’m referring to.
In daylight hours trying to justify the shooting of an unarmed intruder is going to be difficult at best because of the “Imminence” requirement.
I’m not convinced they can’t make the case, I’m just saying it’s a very high bar where Negligent Homicide is a slam dunk.
Here in Texas it’s LTC, as part of the course work we’re required and licensed to teach the applicable law.
She’ll be charged, brought before a Grand Jury and indicted in Dallas County. The DA may try to go for murder but she will at least go for manslaughter. The focus on this case by the Blacks is too intense to go for anything less.
Guyger’s lawyers will move the trial out of Dallas, if they have any sense at all.
Doing that, she may get the lower end of the sentence- maybe 5 years and be out in 3. That’s the best she can hope for.
If you don’t want to get shot by the police in Texas you better not be smoking pot in your house.
Something else Dallas will be angling for is to insure Guyger is considered to have acted as a private citizen and not as a police officer, to avoid a huge lawsuit by the Jean family. The law governing off duty police officers is murky. They immediately become on duty if they encounter a crime. What if they THINK they have encountered a crime. I’m sure we’ll find out before this is over.
That will have no bearing on the outcome of the case.
The City of Dallas will give them a 7 figure settlement if not more just to make it go away and avoid criticism even if they have to take it out of the budget instead of making their insurance carrier pay off.
You have more faith in the justice system than I do.
Even if he was high on everything a human can take her actions were unlawful. His state of mine and whether or not he was impaired is irrelevant.
She had no lawful claim of self defense at all much less lawful use of deadly force no matter what he did.

I’m not even sure they’ll be granted a change of venue. In what county of the state could she get a more fair trial when this has pretty well been nonstop news all across the state?
West Texas where there are few Blacks and no Black hell raisers. Maybe San Angelo.
Have you ever been to San Angelo? There are a lot of blacks in West Texas.
I get what you are saying though, race will undoubtedly play a much bigger part in the trial than it ever has in the shooting or investigation.
Prejudice abounds anytime the person shot is black and a white cop was the shooter.
If they can get a change of venue, the judge will decide where to move it to.
Lubbock and San Antonio are frequent sites trials from Dallas are moved to.
Either would be better than Dallas.
I’m not so sure. LBB has a very large black population. I doubt they can find a cleaner jury pool there than Dallas.
Some of the smaller towns between Dallas and LBB might be a much better choice. Whichita Falls for that matter would probably be very good.
