Congress votes to kill National Emergency...Makes Trump own it completely with VETO as only way around it

It will likely end up passing in the Senate. Three GOP Senators have already stated that they will vote for the resolution against Trump’s national emergency declaration.

I just figured most of us here knew that and that it would get through. But yeah…you are correct.

At no point in this history of this country has the President declared a national emergency to appropriate money for a project that Congress had almost explicitly rejected.

This is a significant separation of powers issue - and its not the NEA that’s being examined.

The reprogramming of funds in the context of a national emergency is limited by the NEA legislation. If you read the actual declaration where the outlines under which statutes he is acting (as required by law) there is plenty to litigate on the reprogramming of funds.

Why does Trump even get a Veto on this?
The declaration was his say in the process, and congress voting to kill the declaration should be enough to check his power.

Trump isn’t appropriating any money.

He can specifically use DOD funds and personnel which he’s going to do.

Litigate away.

He can’t for this purpose.

If he were doing it for a direct military purpose…say directing money away from military construction projects in the US to construction of a military base in another country during war time…sure. But that’s not what this is.

Yes, that is exactly what he is trying to do.

He is trying to spend money on something Congress does not want him to spend money on.

You need to break out a gov’t and/or civics book. He can’t appropriate money period, he can only use money that has already been appropriated.

Are you actually questioning someone elses understanding of civics when you wouldnt admit that McConnel would have to vote on this? Even after it was explained over and over again. You insisted he didn’t have to. Then you disappeared from the thread.

He is trying to re-direct funds from their Congressionally appropriated purpose to fund a project that Congress has rejected.

This has not happened before.

Yes it has going all the way back to at least the Johnson Administration through “Budget Sweep Authority”.

We’ve been over this numerous times, why pretend otherwise?

He most certainly can use unspent Pentagon Construction Funds for this project no matter how much it galls democrats.
