They probably suspected, but were not allowed to search so they weren’t sure.
Hence the request to put a lock on the door probably thinking they would be back.
A probability that proved true as probable cause was developed to get a search warrant and low an behold there were documents still there even after the FPOTUS attorney certified that all had been turned over.

I think that given this was the FPOTUS and that he had made claims that the material was his, and given that the totes they saw had all sorts of documents in them, they gave him deference, and went from there.

Bad faith is saying one was more “actively stolen” than the other. They were both placed in boxes at the White House and transported to,areas under control of the former officials. The same process.

Yeah, that’s true. There is a difference of scale, but sure, they both took things they shouldn’t have.
One party then argued for over a year that they did not have to return anything, and actively fraught the return of the documents. The other party found them and turned them over the next day - at least that is their claim.
It should be investigated though.

The difference is in how the parties involved behaved and are behaving after the discovery of the documents.
One is cooperating…the other is most certainly not.
No amount of equivocating will change that.
And this isn’t even saying Biden should be let off the hook. This should continue to be investigated, and Biden should be requested to look into any documents he took away after Obama’s term ended.
But there is a night and day difference between how Trump’s team has behaved/is behaving than the Biden team.

The “other party” didn’t find them, his attorney did. They were shipped to and located at the building holding Biden’s office until 2019.
Who authorized these to be shipped to Biden’s office. Somebody knew about them years before the attorney found them. They didn’t ship themselves.
