How moronic. I thought the brawl was over after police break it up?

It’s California right? I would guess it’s already illegal for a CCW holder to carry in a bar.

from https://www.usconcealedcarry.com/resources/ccw_reciprocity_map/ca-gun-laws/

Many areas are off-limits, including schools, courthouses and businesses that sell alcohol for consumption.

There we go! Well done.

I was just going to mention that. This Mayor, like most lib politicians, is woefully ignorant of existing gun laws, so it’s no wonder that they think they need more laws.

He’s stated CCW holders would be exempted from this law.

But… using the scenario he just gave… is it perfectly ok to conceal carry in California without a permit? And then if you get caught without the insurance and registration permit, you can go down to the police station and just pick your firearm back up if you get the insurance?

Where did you see that? It’s not in the linked article.

While some would be exempt, including those in law enforcement, those with concealed-carry permits, and those for whom the fee would be a financial burden, pushback is expected, the mayor acknowledged.

Thanks, but I’m still not seeing it in that link. Was there another link posted?

Oops sorry- here it is.

Well, looks like that covers the criminal element.

Good article.

Also my beef with his description of the bill and his intended purpose…

He states this will hold gun owners more responsible for the costs associated with firearm injuries. Yet you can’t get insurance for deliberate misuse of a firearm. How much of that $442 million cost is associated with an accident discharge as opposed to criminal use of a firearm?

This “law” is racist.

Kudos to these groups.

“It may or may not force our group and gun owners throughout San Jose to associate with people who they may or may not agree with.”

Paying money to the city, who will distribute it to an organization that hasn’t been formed yet and has zero accountability, just so they can practice their constitutionally protected right.

No way in hell this can stand.

This organization could send the money anywhere… it’s not being controlled by the city, so they could do anything with the money and those paying in would have no say in the process.

So apparently the challenge to the punitive fee has failed. San Jose gun owners will be paying money to an organization that’s undefined… money could go toward individuals or groups that encourage them to give up their firearms or fund organizations that lobby for that goal.

This isn’t over. Be patient

It’s a new year… firearm owners are being forced to pay the registration fee and insurance. Thing is the “nonprofit” isn’t even created yet… so where’s that money going? What’s it going to be used for? San Jose doesn’t ■■■■■■■ know because this ordinance is retarded.

According to this

The fee isn’t being collected, because the non profit hasn’t yet been selected.

The court battle has just begun, and it takes time: Bruen started its journey in 2018 but wasn’t struck until 2022.

So when I say be patient, I mean allow more than 4 months. But in the end, I just don’t think this court allows this ordinance to stand.

I like these paragraphs:

But the issue of coverage may be more complicated. Councilmembers Maya Esparza and Dev Davis previously said most insurance agencies they talked to told them only accidental firings outside of a household could potentially be covered. Negligence or criminal behavior would not.

“I spoke with two insurance agents including my own from different companies and neither of them said that negligence use is specifically covered in their policies,” Davis said. “I’m still not certain how we can require a specific type of insurance that does not exist.”

So possibly every firearm owner could be out of compliance. That’d make enforcement easy… just arrest all the firearm owners.

I didn’t see anything about arresting people, just a fine. Regardless, yes: that is how it works. Somebody has to suffer harm in order to get standing and then go to court.

I am not advocating for this law. I have said repeatedly that I think it will be struck. But that takes time, and there is a process. That is why I counsel patience.

Unfortunately, the people there will have to wait until this case leaves California for the grownups court.

In the meantime, I’m sure they enjoy being fleeced like this. Can’t wait to see the next Census.
