Yes that is true, but courts can’t compel El Salvador to return its own citizen back to the US. SCOTUS also said District Judges can’t make decisions on things outside their districts, something Boasberg continues to ignore. What does he not understand that there are 677 other judges just like him that have districts just like him, he is usurping their authority with what he’s doing. You can’t be in DC and rule on what should happen in Florida. That’s not his jurisdiction. Boasberg is not a judge he’s a liberal advocate.
The bigger problem I have is SCOTUS made it abundantly clear that Fed District Judges have no jurisdiction outside their chosen district, yet they ignore the 5-4 ruling. Boasberg is literally usurping the power of 677 other Federal District Judges with his actions. The cases he is trying to rule on aren’t from his district.
Boasberg is certainly engaging in a specific type of tyranny as described by Madison:
”The accumulation of all powers, legislative, executive, and judiciary, in the same hands [Judge Boasberg] . . . may justly be pronounced the very definition of tyranny.” ___ Madison, Federalist Paper No. 47
Boasberg history is enough to call him an activist instead of a judge. He doesn’t care these cases are outside his jurisdiction, he thinks he is the 10th Supreme Court justice. Districts mean nothing to him. Dude is holding the DOJ in contempt in regards to cases outside his district, dudes exactly who Madison warned us about. The DOJ has a legal obligation to not comply with Boasberg. If they complied with Boasberg they would be infringing on the rights of 677 other Federal District Judges.
SCOTUS used the word “Facilitate” which is basically saying try to work with El Salvador to get him back if you can. El Salvador said they aren’t doing it, so that case is dead too. US courts have no authority on how other countries should try their criminals. Just like a Federal District Court in DC can’t tell a Federal District Court in Texas how to rule. Wait liberals are trying that as we speak. Then when the DOJ doesn’t comply with an unconstitutional ruling that district judge holds the DOJ in contempt
