Absent a settlement, the government will be forced to defend hundreds of these lawsuits. The flimsy legal positions and actual malice would be exposed in a constant barrage of court hearings. Previously sealed court docs would become public.
If the Congress members prefer that, I’d support their decision to try these cases and then defend that position when the malicious actions are presented to a sympathetic jury.

You can complain about the ACLU all you want… but the Trump adminstration lost in court and they stopped the policy.
With what we know about internal documents and emails about how the policy was implemented it would not go well in court.
This is why they are settling.
