Thousands of people coming into the US (not at a legal border entry point) and then being released into the country does not seem lawful…but I’m no lawyer.

The court determined this in the preliminary injunction phase. In the above ve referenced MsL v ICE.

Here, each Plaintiff presents different circumstances, but both were subjected to the same government practice of family separation without a determination that the parent was unfit or presented a danger to the child. Ms. L. was separated from her child without a determination she was unfit or presented a danger to her child,

They weren’t separated for either of those reasons. Moot.

We agree. They were not separated due to a determination that the parents were unfit. They were denied due process. It’s not moot. It is central to mostif not all, of the cases.
If you think the Judges are wrong, I think it would take a better argument to persuade them to reverse their rulings.

No, they were not denied due process. Their due process is an immigration hearing.

They were separated because we don’t build family housing for detainees in custody.
