Congress passed it in 1980 and gave POTUS the power to make, raise or lower the cap.

And it is obvious why you neglected to do so . . . you neglected to do so because our federal legislature may not delegate its power to enact, suspend, or repeal laws. Nor may it delegate such essential elements of its lawmaking power as its power to declare principles and standards, or general public policy (Lee v. Delmont, 228 Minn. 101: Knight and Wall Co. v. Bryant, 178 So 2d 5, (1965); Nahlen v. Woods, 255 Ark. 974; 16 Am Jur 2D; Constitutional Law, § 337.

Of course, Congress may delegate authority to carry out non-legislative functions after laying down a complete and definite declaration of policy and established objective standards or guidelines (United States v. Rock Royal Co-operative, Inc., 307 U.S. 533, 59 S.Ct. 993, cert. den. 60 S.Ct. 66; 16 AmJur 2d, Constitutional Law, § 339).

So, the question is, is the Biden Administration’s handling of foreigners flooding across our southerner border in harmony with the declared principles standards and general public policy as adopted by Congress? For example, are the so called “public charge” rules and criteria under which foreigners may be denied entry into the United States, being enforced?

How about the merit based criteria under which “refugees” may be denied entry, e.g.: see: 8 USC 1158: Asylum, are they being followed?

(2) Exceptions

(A) In general

Paragraph (1) shall not apply to an alien if the Attorney General determines that-

(i) the alien ordered, incited, assisted, or otherwise participated in the persecution of any person on account of race, religion, nationality, membership in a particular social group, or political opinion;

(ii) the alien, having been convicted by a final judgment of a particularly serious crime, constitutes a danger to the community of the United States;

(iii) there are serious reasons for believing that the alien has committed a serious nonpolitical crime outside the United States prior to the arrival of the alien in the United States;

(iv) there are reasonable grounds for regarding the alien as a danger to the security of the United States;

(vi) the alien was firmly resettled in another country prior to arriving in the United States.

(B) Special rules

(i) Conviction of aggravated felony

For purposes of clause (ii) of subparagraph (A), an alien who has been convicted of an aggravated felony shall be considered to have been convicted of a particularly serious crime.

(ii) Offenses

The Attorney General may designate by regulation offenses that will be considered to be a crime described in clause (ii) or (iii) of subparagraph (A).

(C) Additional limitations

The Attorney General may by regulation establish additional limitations and conditions, consistent with this section, under which an alien shall be ineligible for asylum under paragraph (1).

(D) No judicial review

There shall be no judicial review of a determination of the Attorney General under subparagraph (A)(v).

See that number 5500, now go and read up on annual deportations which was 20,000 last year and every year since 2015. You can see were I am getting my math it’s not hard.

Only Biden increased from 15000+ to over 60000. Germany was never taking in that many after the tragedy that Frau Merkels Willkommenskultur in 2015 since then the Christian Democrats have been losing members left and right and ushered in for the first time into the government a right wing party AFD the first since WW2. This was the social cohesion part I was talking about.

My parents are from Germany and I have been going there since I was a kid to see my family. The migrant situation in Germany isn’t a success they don’t do well with immigrants as America does. If one needs a reality check go to Munich or Cologne the segregation has already started.

The unavoidable truth is, our socialist/fascist revolutionaries, Joe Biden and Kamala Harris, have a plan for “free” college tuition, and cancelling student loan debt. The problem is, it will be paid for by taxing millions of college graduates who worked for and paid their own way through college and are now trying to finance their own economic needs.

The costs don’t look so bad for a single adult male. The real costs are as I said before:

As someone who has spent countless hours researching this topic, I to like you, have found that those on the Left do like to cherry pick their data and they also NEVER factor in the costs of their children. The shocking reality in America today is the astronomical costs to support a child. In NJ for example, when you factor in education, healthcare, housing, meals, + potential other, that can easily exceed $50,000 per child. Exactly how many refugees or illegal immigrants are paying over $50,000 per year in taxes?

Now factor in 3 or more kids and those costs go up exponentially.
