Utah this last legislative session passed a law that allows Tesla to sell their vehicles in Utah.
2008 Bush denied a waiver for California. 2009 Obama bacame president and approved it. The court case California filed was never resolved – probably dismissed as a moot case.
Unless the law says “MUST” approve waivers, then the president has authority to deny a waiver.
