You are missing the point. They came into the country illegally and then play the asylum card. The law says the are either supposed to make their claim at an official entry point or be in the country legally when they make their claim. Biden is allowing them to break the law and still make their claim for asylum without anything other than their word to support it. And not even close to “most” have legitimate claims. These people are desperately poor, they will say anything to stay here.

Entering the US at a time or place not designated is a misdemeanor the first time, so it is still a crime. The misdemeanor doesn’t go away because you applied for asylum after you were caught.

reading is your friend, you should learn to do it, and maybe even understand what you read. i didn’t say they couldn’t claim it, i said it was a bar to claiming asylum, and it is. it is considered prima facia that what they came here for was not asylum. it is a bar to the claim, one they have great difficulty overcoming as the burden shifts completely onto them to prove their claim is not fraudulent.

The key word is “legally.” if you come in illegally, you can be immediately deported and file your claim for asylum at an official entry crossing like the law requires.
