Anthony Kennedy officially takes senior status today.

While this ends his service on the Supreme Court, it certainly does not end his service on the Article III Courts.

It is expected that he will spend a considerable amount of time sitting with the various Courts of Appeals, most likely the 9th Circuit, from which he was plucked by President Reagan.

As a Senior Judge, he is permitted to sit with any Article III Court in the land, other than the Supreme Court. I don’t expect he will hold down a 100% caseload by any means. More likely he will handle a 25% to 50% caseload. That would leave him time to lecture and write.

Good luck in semi-retirement Justice Kennedy.

The new Circuit Justice allotment was released today. Looks like the only change is that the Chief Justice is taking the 9th Circuit spot previously held by Justice Kennedy. It will be interesting to see if future Justice Kavanaugh gets the 9th Circuit when he is confirmed or if there will be musical chairs regarding circuit assignments.

It is ordered that the following allotment be made of The Chief Justice and
the Associate Justices of this Court among the circuits, pursuant to Title
28, United States Code, Section 42, and that such allotment be entered of
record, effective August 1, 2018.
