And you’ve never carried a gun.

Why are you here talking about “draw”?

Not everyone.

The gunfire was one way.

On his property?

Not what happened. You are creating a fantasy narrative to rationalize. Adding in your own details.

No. You went too far.

Aid rather than force?

Serve rather than enforce?

What a cluster ■■■■■
Three cops discharged their weapons?
The homeowner stepped outside his/ her home raising and pointing a weapon at the LEOs correct?
If so and I’m not familiar with NM castle doctrine but here in FL the so-called “stand your ground” and “retreat no further” defenses only apply inside the home or inside a vehicle.
With a valid CCWP you cannot draw your weapon and use lethal force unless you are threatened with lethal force.
Tragedy, a family will never be the same and the LEOs likely will likely lose their jobs having to live with their decisions to shoot.
Did the radio dispatch give the wrong address?
Gawd

He was “brandishing” his weapon and that escalated this whole matter IMO to what the officer’s reasonably believed was a life/death situation.

wave or flourish (something, especially a weapon) as a threat or in anger or excitement:
“a man leaped out brandishing a knife”

Did you read the article and watch the video ?

Well, it’s a discussion board; thought it was ok to discuss things

He was literally in his doorway so at least partially still inside

I’m not defending anyone. But showing your weapon opening a door is risky.

Yes…this man has the right but he’s also entering into a situation, right outside of his door, where those there are armed and on a high alert status. Although I may have the right, I also have the sense to find out what’s going on before I open a door I’m safer behind and bring a loaded weapon into the situation. Regarding this, I can see both sides but from the path I’d have chosen, it differs from that of the home owner.

Very much so

I’m a conservative and I’d take the conservative approach which IMO would be to assess what’s going on outside, from a hidden vantage point of safety…inside my home. Once I’ve determined what I’m dealing with…I’d deal with it appropriately and that may very well be armed with a gun.

That said, I agree with your assessment from a legal POV.

Yes.

Try doing it from a place of knowledge. Pretty easy to blame the dead guy.

We agree on much but in this case, we don’t and that’s ok too.
