Not directly. The case the President tried to make was that the Venezuelan government was sending TdA gang members to the US in order to kill Venezuelan nationals in this country who oppose Maduro. If he were able to successfully make that case, he would have been authorized to use AEA to remove those alien enemies. No congressional action would be required.
We are now discovering that the Venezuelan government isnāt sending TdA gang members to the US. That isnāt to say the gang members arenāt coming. Itās just that they arenāt being sent by the Venezuelan government. For that reason, I believe Rodriquez correctly ruled Trump is not authorized to use AEA.
The FNC article came out 23 April. But the intelligence assessment came out in February, well before the AEA proclamation. The AEA proclamation was based on the FBI assessment, even though other agencies disagreed.
