A pardon question

lets say trump pardons his kids.
courts have already said that accepting a pardon is an admission of guilt

lets say a state then charges the kids with a crime.
could the state then use the acceptance of a pardon as evidence of guilt against the kids.

A prosecutor could probably make that argument, but it certainly wouldn’t hold much legal weight.

A prosecutor for sure could not compel them to take the stand or admit guilt in any way as that would be a violation of the 5th. Also, a presidential pardon only covers any federal charges. The state would still have to prove their own case.

I don’t know.

But when you see the sentence:

You immediately think: this is a healthy polity.

What’s really crazy, is that we’ve seen the writing on the wall for this since 2017. Trump explicitly said he had the right to do it in 2018. Should have been alarm bells.

Can’t believe that was only 2 1/2 short years ago.

The chances of that working are extremely low to zero though. It’s a centuries old precept of Anglo-American law that you can’t stand in judgment of your own crimes.

Better yet, he pardon’s members of his syndicate at 9:00AM, resigns at 9:30AM. Pence become President, then President Pence pardons Trump by 10:00AM.

At 12:00 Noon Biden gets sworn in as the 47th President.

Pence becomes #46 for a couple of hours and totally screws the Biden/46 merchandize for all the vendors.
