You are slightly correct, but mostly wrong.
The concept is what is or is not hearsay is very complicated - to the extent that the topic of Hearsay takes up more than half of the semester of âEvidenceâ if you take the class in law school.
At its simplest, hearsay can be defined as eyewitness testimony made outside the courtroom. That can mean second-hand testimony - Person A testifying to what Person B told them - but it is wider than that.
Testifying in court is not hearsay. An affidavit is.
Yes, it absolutely is - until he testifies in court, with the opposing attorney there to cross-examine.
