The response at the state and local level is always the responsibility of the governors and mayors.
Without a declaration of martial law and federalizing all state resources putting them under command of the federal gov’t the president cannot replace them.
The DPA was enacted, and every resource available was put into producing, testing capability, vaccines, PPE, respirators, drugs for therapies and they were all distributed to the state.
Your state and local health authorities however remain responsible for distribution.
This is just like all the bitching about the response in Puerto Rico during the hurricane and it’s recovery when the bottleneck was always the local/state officials who failed to prepare and failed even worse to distribute the aid that was delivered in the biggest air and sea lift since WWII.

Of course it does when the local Gov’t does it’s job instead of becoming enablers.
If the locals don’t have the resources you call in county and state resources and if those aren’t enough you call on the governor to mobilize the national guard.
A riot is like a fire, it only gets out of control if you allow it to.

I am planning on voting for Biden. Here are the three the reasons why:
- The courts. Trump has already nominated a lot of people to the courts. Trump has nominated two people to the Supreme Court. I want Biden to nominate Ginsburg’s replacement for the Supreme Court.
- I am in a battleground state.
- Trump and his administration have broken laws and ignored the Constitution separation of powers.

Sorry, I disagree. Testing supplies have not been nationalized, there are several states now who are running seriously low. Every state had to fend for itself. There was no standardized test, no supply chain for testing and there still is not one.
PPE manufacturers here in the US were ready to go but never got a Federal order to manufacture N95s. We are still low on them in many parts of the nation.
What Trump did Federalize is Ventilators. Do you see anyone needing Vents right now? No. Because that is what Federalizing something does, it makes things happen. He did this right, why couldn’t he carry this success to the next level?
He also did vaccine development right, by the way. Warp Speed is a damn good idea.
So why not the rest? Why not just take charge? Why force Governors and local health departments to shoulder the burden on something they are completely unqualified to do? This is an INTERNATIONAL pandemic, a once in a century problem.
Trump should man up and do his damn job. The CDC should be the ones instituting when places can be open or closed, when schools should reopen, how they should reopen, etc. This is not a local or state problem, not in the least.

Only the sates have the infrastructure to deal with state and local response, all the fed’s can do is provide them support which has been done since day one.

Sadly, this election is really between someone who is missing in action (radical left is waiting in the wings) and Trump. The pandemic is putting us in a position where the one in the WH loses by default. Thus radicals win and God help us.

Trump cannot by any statute or line of the constitution dictate the response of the states, or citities to the virus, all he can do is that which he has which is to provide support and guidance.

Actually Title VII and III of the DPA does exactly that, it gives the President the ability to nationalize an industry and coordinate the dispersal of materials created by it. He has yet to invoke it for testing and still has states competing with each other and the Feds for the same pool of testing materials.

You are wrong, the public/private partnership to produce and process the tests was one of the first moves announced after enacting the DPA. It started in fact even before the DPA was invoked.

And it failed. Labcorp is still having 2 week turnarounds in Florida right now. We aren’t mass producing rapid tests. There are lines that last for hours right now in the sunbelt.
Because the states are still on the hook for the testing, not the Feds. There are no Federal contact tracers, no standardized test, no uniform supply chain.

Newsflash, we have never had unlimited testing ability for any disease, the capability does not and cannot exist.
No test for this disease even existed until late January.
There are still serious problems with both false positives and negatives with the rapid tests so what is your point? Should the POTUS put all our resources into producing an unreliable test?
