Having a lawyer respond isn’t the same as taking part. Compelling him to say anything or cooperate in any way past appearing is the stretch. And this seems to be a question for the voters, not the courts.

What I have read here is he has to prove he didn’t aid an insurrection. The accused doesn’t have to prove anything, that task belongs to the accusers.

IMO yes. Seditious conspiracy means at least two people planned to interfere with the enforcement of a law. Insurrection means overthrowing a government.

I don’t know if she will appeal or not, the court hasn’t rendered a decision.

I expect the court to find her eligible to appear on the ballot, so if she wins I doubt she will appeal. If she loses, I fully expect and appeal.

Cawthorne on the other hand challenged the Board of Elections review and won. So now it would be up to the BOE to appeal that Judges ruling if they choose.
